När parterna har undertecknat avtalet är bostadsrättsföreningen skyldig att upplåta bostaden till köparen, oavsett om köparen godkänns som medlem eller inte. De flesta förhandsavtal innehåller en klausul om teckningsgrad, vilket innebär att avtalet endast blir giltigt om en viss andel av bostadsrätterna säljs inom en angiven tidsperiod. Vad måste ett förhandsavtal innehålla? Ett förhandsavtal måste vara skriftligt. Muntliga avtal kan skapa tvister och missförstånd, vilket gör det viktigt att ha en formell skriftlig överenskommelse. För att vara juridiskt bindande måste avtalet innehålla följande information: Namn på parterna som ingår avtalet Namn och uppgifter om bostadsrätten som ska upplåtas Beräknad tidpunkt för inflyttning Ungefärlig kostnad för bostaden Eventuell förskottsbetalning Om förhandsavtalet inte uppfyller de obligatoriska juridiska kraven eller bryter mot lagstiftningen, är det inte rättsligt giltigt. I så fall kan parterna inte åberopa det i en rättslig tvist. Vilka krav finns för att ingå ett förhandsavtal? När ett förhandsavtal tecknas måste det finnas ett giltigt kostnadskalkylintyg utfärdat av Bolagsverket. Kostnadskalkylen ska ange den beräknade kostnaden för föreningens fastighetsförvärv samt kapital- och driftkostnader. Dessa kostnader kan dock ändras. Investeringens storlek, månadsavgiften och insatsen kan variera. Men det finns en lagregel som skyddar köparen mot oskäliga förändringar i avtalet. I vissa fall har denna regel gett köparen rätt att häva avtalet och avstå från köpet. Om en förskottsbetalning krävs måste bostadsrättsföreningen ha tillstånd från Bolagsverket att ta emot förskottet. Tillståndet beviljas endast om föreningen har en godkänd kostnadskalkyl samt säkerhet för återbetalning, exempelvis i form av en bankgaranti eller försäkring. Dessa regler finns för att säkerställa att köpare får tillbaka sitt förskott om projektet inte genomförs. Att ta emot förskott utan tillstånd är straffbart. För att säkerställa att förhandsavtalet är giltigt och att förskottsbetalningen är korrekt hanterad, bör parterna rådgöra med en jurist specialiserad på bostadsrätter. Varför är det viktigt att ha rätt timing vid överlåtelse? Tidpunkten för överlåtelsen är avgörande för att förhandsavtalet ska vara giltigt. Överlåtelse innebär att bostadsrätten formellt övergår till den nya ägaren. Köparen har rätt att veta när bostaden blir inflyttningsklar. Om överlåtelsen försenas avsevärt har köparen rätt att häva avtalet. Vad som räknas som en rimlig tidsfördröjning är en fråga som ofta avgörs i domstol. Det är en god praxis att ange ett specifikt datum i avtalet, även om det inte är ett krav enligt bostadsrättslagen. Vad säger lagstiftningen om förhandsavtal? Riksrevisionen publicerade 2020 rapporten ”Konsumentskydd vid köp av nyproducerade bostadsrätter”, där de påpekade att skyddet för bostadsköpare behöver stärkas. Regeringen arbetar nu med att uppdatera bostadsrättslagen för att ge bättre konsumentskydd. Generellt gäller avtalsrättens grundprinciper för förhandsavtal. Avskedad Med Omedelbar Verkan Att bli avskedad med omedelbar verkan betyder att en anställd har fått besked om avsked och att det ska genomföras omedelbart. Avsked är den strängaste åtgärd en arbetsgivare kan vidta mot en anställd. Till skillnad från en uppsägning medför ett avsked ingen uppsägningstid. Bedömningen av faktorerna som kan leda till ett giltigt avsked är strängare än vid en uppsägning. Efter att avskedet har utfärdats måste det vara berättigat. Ett avsked är endast giltigt om den anställde grovt har åsidosatt sina arbetsuppgifter. I AD 2021 dömdes en polisman för ett liknande fall, där han var borta i två veckor trots att hans semester endast var en vecka. Hans förklaring om sjukdom i andra veckan accepterades inte, och avskedet ansågs giltigt. Dessa domar visar att obehörig frånvaro, särskilt i samband med semester, kan utgöra grund för ett giltigt avsked. Vilka tidsfrister gäller vid avsked? Arbetsgivaren kan inte avskeda en anställd om den varit medveten om avskedsgrunden i mer än två månader. Avsked måste meddelas den anställda minst en vecka i förväg. Kan en anställd avskedas med omedelbar verkan samma dag? Ja, en arbetsgivare kan be den anställda att lämna arbetsplatsen omedelbart vid avsked. Arbetsgivaren kan också neka den anställda tillträde till arbetsplatsen. Om den anställda anser att avskedet är orättvist kan denne ta ärendet till domstol med stöd av sitt fackförbund. Kan en anställd avskedas utan förvarning? Även om det vanligtvis ges en varning innan avsked, är det lagligt att avskeda en anställd utan varning om skälen är tillräckligt allvarliga.
